SALON POLICY & LIABILITY 

 

-WE RESERVE THE RIGHT TO REFUSE SERVICE TO ANYONE.

• We reserve the right to refuse service to individuals with suspected contagious nail conditions, open or infected wounds in the treatment area, those in ill health who may be contagious or at risk of harm from our services, and anyone displaying rude, mean, or disrespectful behavior.

• Please acknowledge that beauty and wellness treatments may involve certain risks, including allergic reactions, skin irritation, or other unforeseen side effects. 

• For clients with diabetes, please inform our technician to ensure proper care. Note that cutting services are not permitted. 

• We do not perform cuttings for ingrown nails unless you request our technician to do so as we will make an effort to accommodate you while releasing us of liability. This applies to clients with diabetes as well.

• For the safety of our customers, please be aware that our spa chairs have a maximum capacity of 250lbs. If you exceed this weight limit, we kindly ask that you refrain from using the spa chairs for your own safety. Your understanding is greatly appreciated.

• We love pampering children's nails! However, unattended children can be disruptive and pose a safety risk. If you have children under 8 who are not receiving nail services, please ensure their safety or leave them at home. We appreciate your understanding.

 

-LIMITATION OF LIABILITY :

• Limitation of Liability: In no event shall Top Coat Nail Studio, Inc., including our directors, officers, employees, affiliates, agents, contractors, or licensors, be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in any way connected with the use of our services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if advised of the possibility of such damages. Our liability is limited to the maximum extent permitted by law.

• Our liability to you for any cause whatsoever and regardless of the form of the action shall at all times be limited to the amount paid, if any, by you to us.

• You agree that under no circumstances shall Top Coat Nail Studio, Inc. be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of our services or digital platforms.

• We are not liable for damages in connection with any failure of performance, error, omission, denial of service, interruption, defect, delay in operation or transmission, computer virus, or unauthorized access to your information or property.

• We recognize that certain state laws and international laws may not allow limitations on implied warranties or the exclusion or limitation of certain damages. Therefore, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights under applicable laws.

• By booking an appointment with us, you consent to our policies and agree to proceed with the salon services.
